General terms and conditions of the Club Rooms at Aspria Royal La Rasante

 

1. Generalities:
These general terms and conditions form an integral part of and govern all the services provided by SA LA RASANTE (registered office Rue Sombre 56, 1200 Brussels, number 0472.238.065 on the official Belgian companies database and identified for VAT purposes with the same number - hereinafter "Aspria Royal La Rasante") to the natural person or legal entity (hereinafter "the Customer") who requests a service either in his/her own name and on his/her own behalf or in the name and on the behalf of a third party.

In making a booking or ordering a service at Aspria Royal La Rasante the Customer is presumed to have irrevocably accepted these general terms and conditions.

No exceptions to these general terms and conditions may be granted, except by prior, express and written agreement between Aspria Royal La Rasante and the Customer.

All other terms and conditions to which the Customer might refer are not binding on Aspria Royal La Rasante.

2. Bookings:
Aspria Royal La Rasante and the Customer enter into an agreement by means of a booking requested by the Customer, which the Customer must notify in writing (letter, email, fax). The booking will only be effective if it is confirmed by Aspria Royal La Rasante by email or letter. Services provided by Aspria Royal La Rasante correspond to the content of the confirmation. If the customer makes bookings for other people, he/she irrevocably undertakes to be the person liable for payment of the invoice. The customer declares that the booking is made for his/her personal requirements. Consequently his/her right of use remains strictly personal and non-transferable.

If the booking is made on the day of arrival, no cancellation is possible. Subject to point 6 below on bookings during special events in Brussels, bookings may only be cancelled up to 24 hours before the day of arrival.

3. Bookings for children:
Children under the age of 6 sharing their parents' room stay for free. An extra bed or cot may be requested on booking at the fixed cost of €15/day. Children under the age of 16 may share their parents' room for a fixed cost of € 15/day. This must be specified on booking. A maximum of one child is permitted per room except in suites which can accommodate up to two children.

4. Arrival and departure times:
Rooms are placed at the Customer's disposal from 15.00. The Customer must check in no later than 19.00. On departure, Customers must vacate their rooms by 11.00.

5. Rates and payment terms:
The rates charged are those mentioned in the booking confirmation. Except by prior written agreement, the applicable rates are those stated on the price list displayed in Aspria Royal La Rasante. Depending on the size of the booking, Aspria Royal La Rasante may ask for a deposit of a maximum of 80% of the total amount of the booking when the booking is confirmed (except for "Early bookings" when the total amount will be requested on confirmation of the booking). If a deposit is requested but has not been paid by the Customer within three days of being requested, Aspria Royal La Rasante may rent the rooms concerned to a third party without prejudice to the right of Aspria Royal La Rasante to claim standard compensation of one night per booked room. If the Customer cancels his/her booking without giving the 24 hours notice specified in point 5 above or if he/she does not pay the requested deposit within the three-day period, the amount of one night's stay per booked room will be owed by the Customer to Aspria Royal La Rasante (subject to the compensation specified in point 6 below concerning bookings during special events in Brussels). Any outstanding amount due to Aspria Royal La Rasante may be deducted from any deposit. Aspria Royal La Rasante require a valid credit card number on booking to guarantee amounts owed to Aspria Royal La Rasante. The Customer agrees that Aspria Royal La Rasante may use this card to take any amount owed by the Customer and still unpaid upon checkout. On checkout, the Customer may choose his/her means of payment (cash, credit card). Payment by cheque is not acceptable however. Except by prior written agreement between the parties, the amounts owed by the Customer to Aspria Royal La Rasante must be paid on checkout at the latest.

6. Terms and conditions for cancellations and no-shows:
The Customer undertakes to advise Aspria Royal La Rasante as soon as possible of any cancellation of a booking through: www.aspriahotels.com - reservations.rlr@aspria.com or by calling +32 2 609 19 90. Confirmation of your cancellation request will be sent to you within 24 hours. You will be asked for this in the event of a dispute.

Any cancellation not made 24 hours before the day of arrival or any no-show will incur payment of compensation by the Customer to Aspria Royal La Rasante equal to one night per booked room, subject to point 6 below concerning bookings during special events in Brussels.

In the event of an early departure or after 11.00 the Customer will also owe Aspria Royal La Rasante payment for one extra night per booked room. Except by prior written agreement, Aspria Royal La Rasante may rent to third parties rooms which the Customer has not checked into by 19.00 at the latest or for which the Customer has still not paid the requested deposit.

7. Terms and conditions during special events in Brussels (fairs, conferences, seminars, etc.):
As an exception to the foregoing points, cancellation of a booking taking place during special events in Brussels must be made no later than 14 days before the day of arrival. Any late cancellation will incur payment by the Customer to Aspria Royal La Rasante of an increased amount of compensation calculated as follows:

- 50% of the total amount corresponding to all nights booked if the cancellation is made between the 7th and 14th day before the day of arrival,

- 75% of the total amount corresponding to all nights booked if the cancellation is made between the 3rd and 7th day before the day of arrival,

- 100% of the total amount corresponding to all nights booked if the cancellation is made after the 3rd day before the day of arrival. In the event of a deposit being requested when the booking is confirmed, the deposit must be paid within three days of confirmation of the booking by Aspria Royal La Rasante. Failing this, compensation equal to 50% of the total amount corresponding to all nights booked will be owed by the Customer to Aspria Royal La Rasante and Aspria Royal La Rasante will be able to rent the rooms to third parties.

8. Liability, legal jurisdiction and law of the contract:
Aspria Royal La Rasante is not liable in the event of theft of objects belonging to customers. To be valid, any claim by the Customer to Aspria Royal La Rasante must be sent to Aspria Royal La Rasante by registered letter only, no later than eight days after the end of the stay in Aspria Royal La Rasante. The Customer irrevocably waives the right to any other claim.

9. Cancellation and changes to a booking by Aspria Royal La Rasante:
If upon arrival of the Customer who made the booking, no rooms are available at Aspria Royal La Rasante or in the event of force majeure, Aspria Royal La Rasante reserves the right to provide accommodation for the customer elsewhere under the best possible conditions. In this case, the costs inherent in the transfer will be met by Aspria Royal La Rasante and the customer shall waive, where appropriate, any other compensation of any kind on any grounds.
Aspria Royal La Rasante may release itself from its obligations or suspend their performance if it finds itself unable to provide them due to the occurrence of an event beyond its control or in the event of any force majeure and in particular in the event of the total or partial destruction of Aspria Royal La Rasante, strike, disaster, fire, internal or external technical accident and generally any event not permitting the service to be properly carried out.

10. The Customer's responsibility:
The Customer undertakes to occupy Aspria Royal La Rasante responsibly and particularly with respect for the stay of other Customers. Any Customer who does not respect the tranquil stay of other Customers may be asked to leave. If the Customer is asked to leave, he/she will remain liable for the cost of the nights booked. The Customer shall assume liability in relation to Aspria Royal La Rasante and other Customers for any deterioration and damage caused by him/her or any person under his/her responsibility.

11. Aspria Royal La Rasante's liability and the depositing of items at Aspria Royal La Rasante:
Aspria Royal La Rasante is not liable for damage occurring as a result of an event which could not be foreseen (force majeure), in spite of the necessary precautions, due to the circumstances and consequences.
It is not liable for damage caused through an error, even a partial one, by the Customer. The Belgian Civil Code (law of 4 July 1972, Belgian Official Journal of 19 August 1972) governs deposits in the following articles:

Article 1952: The hotelier is liable, as depository, for any deterioration, destruction or misappropriation of objects brought to the hotel by the traveller who stops there and takes lodgings. The depositing of such objects must be considered as a necessary deposition. Objects considered to have been brought to the hotel are:

a) Objects that are there while the traveller is using the accommodation;
b) objects which the hotelier or a person providing his/her services to the hotelier assumes responsibility for guarding outside the hotel while the traveller is using the accommodation;
c) objects which the hotelier or a person providing his/her services to the hotelier assumes responsibility for guarding either at the hotel or outside the hotel for a reasonable period preceding or following that in which the traveller is using the accommodation.
The liability referred to in this article is limited per claim to 100 times the price of renting the accommodation per day. The King may specify where appropriate the elements enabling this price to be determined. The Royal Decree of 24 June 1973 (Belgian Official Journal of 14 August 1973) states that the price for renting accommodation per day (which is referred to in article 1952, paragraph 3) comprises the price per night, as advertised by the hotelier, plus a percentage (possibly anticipated) for the services offered.

Article 1953: The hotelier's liability is unlimited:

a) when objects are placed in his/her care or the care of persons providing their services to the hotelier;
b) when he/she has refused to allow the depositing of objects that he/she is obliged to accept;
c) when the deterioration, destruction or misappropriation of objects specified in article 1952 is due to his/her fault or that of persons providing their services to him/her.
The hotelier is obliged to allow the depositing of paper securities, coins and valuable objects; he/she may only refuse them if they are dangerous or if, relative to the size or conditions of the hotel, they are of an excessive market value or of a bulky nature. He/she can require that the object entrusted to him/her is contained in closed or sealed packaging.

Article 1954: The hotelier is not liable when the deterioration, destruction or misappropriation is due:

a) to the traveller himself/herself or to the persons accompanying him/her, in his/her service or visiting him/her;
b) to force majeure;
c) to robbery with violence;
d) to the nature or defect of the object.

Article 1954bis: Unless the hotelier or persons providing their services to the hotelier are at fault, the traveller's rights are extinguished if he/she does not indicate the damage suffered as soon as it is discovered.

Article 1954ter: Any declaration or agreement aimed at ruling out or limiting the hotelier's liability before the harmful event is void.

Article 1954quater: Articles 1952, 1953 and 1954bis do not apply to vehicles or objects forming part of their load or left in them or live animals.

12. The Customer's behaviour:
The Customer must behave according to the customs and rules of the Club where he/she is staying. The customer may consult these rules on our website or at reception.

Any serious or repeated breach of these rules entitles Aspria Royal La Rasante to terminate the agreement immediately without notice, the cost of the booked nights remaining owed to Aspria Royal La Rasante as lump sum compensation. Smoking is prohibited in the rooms, and is considered a serious fault, incurring standard compensation of 150 euros, without prejudice to any other application for compensation for serious damage or otherwise as the result of smoking within Aspria Royal La Rasante.

13. Use of the car park:
Use of the car park is always at the risk of the person in possession of the vehicle. Aspria Royal La Rasante will under no circumstances accept liability in the event of theft or damage.

14. Use of the club:
The Customer has access to the Club during his/her stay at Aspria Royal La Rasante provided he/she complies with the Club rules. The Customer will ensure that he/she adjusts his/her sporting activity and use of the machines in accordance with his/her physical health and where appropriate his/her medical history. Any incident or accident will be reported to the insurance company on condition that the Club is not rendered liable. The Customer irrevocably accepts that the Club's chargeable services will be entered on the Aspria Royal La Rasante invoice. No valuable property may be brought into the Club by the Customer. Failing this, the Customer shall take personal responsibility for them and neither Aspria Royal La Rasante nor the Club can be held liable in the event of theft or damage.

15. Pets:
Pets are not permitted in Aspria Royal La Rasante.

16. Use of the Internet:
Customers may use the Internet at their own risk and expense. The illegal and or abusive use of the Internet connection provided by Aspria Royal La Rasante is prohibited. It is also forbidden to:

- Download protected files without the author's permission;

- Share and distribute information with immoral or illegal content and/or nature;

- Use applications which might modify and/or destroy the server facility belonging to Aspria Royal La Rasante.

The Customer is liable for any damage caused by inappropriate use or use that does not comply with the general terms and conditions. Under no circumstances will Aspria Royal La Rasante accept liability for damage caused to the Customer, who must use his/her own security provisions (anti-virus etc.)

17. Identification of the person making the booking:
Upon arrival at Aspria Royal La Rasante the Customer is required to present his/her identity card, and that of the people accompanying him/her, so they can be entered on the identification slip that they must sign.

18. Respect for Privacy
The information requested from the Customer at the booking stage is necessary for Aspria Royal La Rasante to register and confirm the booking.

Unless the person making the booking objects, after his/her stay Aspria Royal La Rasante and La Rasante Club S.A. may use the email address of the person making the booking to send him/her its newsletter, promotional offers or an invitation to fill in an online customer satisfaction survey after his/her stay. The customer has the right to object, free of charge, to the use of data relating to him/her for the purpose of recruitment and especially for commercial purposes.

On each data collection form an asterisk indicates whether the response is mandatory or optional. The customer authorizes Aspria Royal La Rasante to pass his/her personal data to third parties on condition that this is compatible with the performance of procedures incumbent upon Aspria Royal La Rasante under these general terms and conditions.

19. Surveillance cameras:
For security purposes the customer agrees to the presence of security cameras in the communal areas such as the corridors, reception area, car park and lounge in order to provide preventive control. The images may be used in the following manner:

- Viewing of images in real time if surveillance is carried out under the control of the competent authority

- Saving of images for the statutory period of 1 month.

It is forbidden by law to use a surveillance camera in a hiding place or in secret. The fact of a person entering a place where a pictogram warns of the presence of a camera serves as authorization to be filmed.

The Commission for the protection of private life has been advised of the presence of cameras in our buildings.

20. Other clauses:
The Customer may not ask for a particular room when the one offered or allocated to him/her corresponds to the category specified upon booking. Rooms may only be used for the purpose of accommodation. Aspria Royal La Rasante may terminate the agreement at any time and ask the Customer to leave if the rooms are used for any other purpose, this being considered serious misconduct on the part of the Customer.

21. General terms and conditions relating to Internet bookings:
These General Terms and Conditions of Internet Sale also apply to all bookings made on the www.aspriahotels.com website, subject to special conditions for certain rates and to the exclusion of bookings made by groups which have booked more than 5 rooms. Any booking made on the www.aspriahotels.com - reservations.rlr@aspria.com website assumes that these General Terms and Conditions of Sale have been read and accepted.

The Customer declares that the booking is made for his/her personal requirements. Consequently his/her right of use remains strictly personal and non-transferable. The rates indicated on the www.aspriahotels.com website are non-commissionable.

Unless a notice to the contrary is displayed, the prices indicated on this site are in euros, inclusive of VAT, per room per night, for a specified number of people per room and for the chosen date.

Unless a notice to the contrary is displayed, additional services (half-board, parking, etc.) are not included in the price.
Resort tax is included in the displayed prices.

A/ Booking confirmation

For bookings made over the Internet an automatic booking confirmation summarizing the elements of the booking will be sent by email.
If you do not receive this confirmation, please contact our booking team on +32 2 609 19 90 or reservations.rlr@aspria.com.

B/ Booking, cancellation and change of booking by the customer

Except where an indication to the contrary is provided under the special conditions of certain rates presented below, as well as during special events in Brussels, the booking may be cancelled or changed by the customer up to 3 days before the expected day of arrival exclusively from the website.
Aspria Royal La Rasante will send an invoice for the first night's stay per room to the person making the booking:

- if he/she does not take possession of his/her room on the expected day without having cancelled at least 24 hours before the day of arrival,

- if he/she cancels his/her booking less than 24 hours before his/her day of arrival,

- if he/she leaves Aspria Royal La Rasante before the end of his/her booking.

The booking takes effect from 15.00 on the customer's day of arrival and ends at 11.00 on the day of departure.

The booking is valid after registration of the type of bank card, the Customer's bank card number, the card expiry date (valid on the date of the stay of the person making the booking) and of the name printed on the card.

Any claim by the Customer after a booking can only be validly made to our Reservations Department or Aspria Royal La Rasante no later than 24 hours after the date of the booking.

C/ Guarantee and payment for your stay

At the time of booking the Customer provides his/her bank details as a guarantee.

D/ Early booking, cancellation and change not permitted

Once the booking is confirmed, Aspria Royal La Rasante reserves the right to debit up to the total amount of your stay from your card.

22. Application of law:
Contractual relations between Aspria Royal La Rasante and the Customer are regulated by Belgian law. Any disputes arising from the interpretation or performance of the contract between Aspria Royal La Rasante and the Customer and in general any relations between Aspria Royal La Rasante and the Customer will fall within the exclusive jurisdiction of the courts and tribunals of the Brussels judicial district.
